Contractors Beware: Avoid Assisting Unlicensed Activity – Protect Your License
The Florida Department of Business and Professional Regulation (DBPR) recently issued a notice reminding contractors that it is illegal to assist or enable unlicensed individuals or businesses to perform contracting work. This includes obtaining permits on behalf of unlicensed parties. Doing so violates Florida Statute 489.129 and can have serious legal and financial consequences.
What Is Considered Unlicensed Activity?
Under Florida law, any action that helps an unlicensed person perform contracting work is considered assisting in unlicensed activity. This includes:

Pulling building permits for someone who is not licensed

Allowing your license number to be used by another individual or company

Entering into contracts or business relationships with unlicensed parties where your license is used to legitimize their work
Even if the intention is to help someone get started, these actions are considered unlawful and are closely monitored by the Construction Industry Licensing Board (CILB).
What Are the Penalties?
The penalties for assisting unlicensed activity are outlined in Rule 61G4-17.001(1)(d), Florida Administrative Code. Violations fall under Section 489.129(1)(d), Florida Statutes, and the penalties are as follows:
Minimum Penalty: $5,000 fine per violation and probation or suspension
Maximum Penalty: $10,000 fine per violation and probation, suspension, or revocation of your license
It is important to note that these penalties apply per violation. Multiple infractions can lead to significant fines, extended probation, or permanent loss of your license.
DBPR Enforcement Is Active and Ongoing
The DBPR has made it clear that it is actively investigating unlicensed activity and will take enforcement actions against violators. Contractors are encouraged to report suspected unlicensed activity, and complaints can be filed anonymously through the DBPR’s website.
